Under Taiwan law, a "foreign spouse" is someone married to a Taiwan citizen. A visa based on this marital status is called a Joining Family Resident Visa (JFRV). Many people posting on forumosa.com have questions about the work rights of foreign spouses after they obtain the JFRV. Do foreign spouses have unrestricted work rights? Unfortunately, I am unaware that there is currently any generic answer to this question. But of course it must be said that Article 48 of the Employment Services Act appears to strongly support such an "unrestricted work rights" interpretation. However, I do know of many persons who have gotten into intense arguments with the local government personnel (in numerous citiies & counties in Taiwan) and the local Police about this. The local government personnel claimed that the foreign spouse did not have unrestricted work rights, and of course the Police went along with this interpretation. As a result, the foreign spouse was taken down to the Police Station to fill out a pile of paperwork. Hence, I would encourage you to approach this matter in an organized way, and direct your specific written inquiries to some knowledgeable person. One good choice might be this KMT Legislator -- LAI Shyh-Bao Tel: (02) 2358-8166, 2708-1120 Fax (02) 2358-8170 The reason I am recommending Legislator Lai is because he sponsored our Public Hearing on "Work Rights for Foreigners" in June 2000. Hence, I can say with certainty that he and his staff have worked on "foreign spouse" issues before. I recommend that you submit a written inquiry regarding your own personal situation and your own personal points of confusion, and then follow it up by a telephone call a few days later. Be sure to include your full contact information. Of course, if you have a better way to research this matter, you are welcome to follow your own methodology.
